The European Commission is proposing three laws that give new, broad powers to EU and national law enforcement authorities, allowing them to racially profile, detain and deport migrants and criminalise NGOs with impunity.

Dear [insert MEP name],

I’m writing to you with deep concern regarding the EU’s upcoming Facilitator’s Package. 

These two new EU laws are set to endanger migrants and humanitarian actors, and give more money and powers to police and border forces with a track record of human rights violations, violence, and death. 

Your vote can help stop this. 

Both these laws will have a disproportionate impact on migrants, refugees, asylum seekers, humanitarian workers, and racialised communities at the EU’s borders and beyond.

The Facilitation Directive:

  • Risks unfairly charging and imprisoning migrants and NGOs with ‘smuggling’ and ‘trafficking’ instead of targeting organised crime

  • Deflects responsibility away from the EU’s failure to provide safe and regular pathways

  • Fails to comply with the EU’s obligations under international law.

The Europol Regulation:

  • Unlawfully offers more powers for EUROPOL and FRONTEX, EU agencies with known human rights violations

  • Allows the collection of sensitive biometric data and promotes racial profiling

  • Wastes money on violent and ineffective criminal law responses to natural human migration.

To rectify these proposals and end the criminalisation of migrants in the Package, we recommend:

  • Amending the Facilitation Directive to include

    • A clear definition of smuggling as a for-profit activity (Article 3)

    • A legally binding humanitarian exemption that protects migrants, refugees, asylum seekers, their families, and human rights defenders from being charged with smuggling (Article 2)

  • Voting against the most harmful parts of the Facilitation Directive

    • Do not make ‘public instigation’ a crime (Article 5)

    • Remove harsh punitive sentences likely to be used against migrants and humanitarian actors (Article 6)

    • Ban the use of special investigative tools (Article 16)

  • Rejecting the Europol Regulation in its entirety 

 It’s wrong to further politicise migrants and use violence, detention and deportations against them and those in solidarity with them. The EU should be upholding international law. 

 EU migration policy should focus on protecting migrants, refugees, asylum seekers, and human rights defenders. EU funds should be moved away from deadly police and border agencies and towards social needs.
